By registering and placing a bid, you agree to the following terms which govern all transactions at this auction.
1. Payment Requirements

Full Payment: All items must be settled and paid for in full before the buyer departs the premises or before scheduled removal/shipping occurs. No merchandise will be released without payment.

All items purchased by the user online must be paid in full within twenty-four (24) hours of
auction close date. Failure to do so could result in your account being placed on hold with Jen's
Auction Centre and you will be unable to bid in future auctions with us until a $50.00 violation
fine has been paid. Second offense will result in immediate termination of your account. Items not paid for within 24 hours will be offered to the second highest bidder at the hammer price or re-posted in a future auction at Jen’s Auction Centre’s sole discretion or the seller may request return of the item.

All items must be removed from our premises 7 days following the auction end date. Any items
not retrieved within 14 days will be considered abandoned and Jen's Auction Centre reserves the
right to re-sell the items on another auction. Any items that have not been removed from our
premises within the timeframe noted above will be treated in the following manner:
Item(s) will be subject to a $10 per item weekly storage fee if not picked up after 7 days. Item(s) that are not picked up during the specified pickup time (this is the 14 days directly following the auction close) will become the property of Jen's Auction Centre and they will be re-sold on the house’s account with no refund to the original buyer.

Fees & Tax: All winning bids are subject to applicable sales tax and a 15% Buyer’s Premium which will be added to the final hammer price of each item.
2. Condition of Goods (No Warranty)

AS IS, WHERE IS: ALL ITEMS ARE SOLD "AS IS," WITH ALL FAULTS AND IMPERFECTIONS. We provide descriptions (in the catalogue or verbally) strictly for identification purposes. It is the Bidder's responsibility to fully examine and inspect the merchandise prior to bidding, and the buyer accepts the item in its present condition. No warranties, express or implied, are offered by the Auctioneer or Seller.
3. Disputes and Final Sale

Designated Winner: The Auctioneer will confirm the winning bidder for each lot.

Dispute Resolution: Should a dispute arise between two or more bidders, the Auctioneer retains the right to resume bidding between those parties. The Auctioneer's final determination of the successful buyer is conclusive.
4. Buyer's Responsibility (Transfer of Risk)

Immediate Ownership: Once a Bidder's offer is accepted (the hammer falls, or the online timer expires), the Bidder immediately assumes full ownership of the item.

Risk of Loss: At the moment of sale, the item(s) become the sole responsibility of the Buyer, who assumes all risk of theft, damage, or loss, regardless of whether the item has been paid for or removed. Buyers should take appropriate measures to safeguard their purchases.
5. Auctioneer's Rights and Changes

Agency: Jen's Auction Centre (The Auctioneer) is acting strictly as an agent for the Owner/Consignor.

Sale Changes: The Auctioneer reserves the right to modify the sale structure, including grouping or subdividing lots, adding items not previously listed, or withdrawing any item from the sale at any time.

Bidding Rejection: The Auctioneer may reject any bid that is considered a nominal or fractional advance if, in the Auctioneer’s judgment, it could negatively affect the auction process.
6. Injury and Damage

Liability Waiver: The Bidder, and anyone accompanying them to the premises, acknowledges responsibility for any personal injury or property damage they cause. The Bidder agrees to hold the Auctioneers harmless from any claim of personal injury or property damage incurred on the auction premises.
7. Removal of Purchases

Buyer's Risk: All item removal is at the sole expense, liability, and risk of the Bidder.

Failure to Remove: If the Bidder fails to remove the item(s) within the time frame specified in the auction terms, the Auctioneer reserves the option to remove and store the items at the Bidder's sole expense and risk.
8. Finality and Announcements

Official Record: The record of sale maintained by the Auctioneer shall be considered final in the event of any dispute.

Precedence: Any announcements made on the day of the sale shall take precedence over any prior printed materials, website text, or catalogue descriptions.
